3. QUOTES AND VARIATIONS

Quotes are based on information available at the time
3.2 Variations
Variations may arise from:

Client-requested changes

Latent or unforeseen site conditions

Changes in materials, supplier costs, or regulations
All variations must be:

Confirmed in writing

Approved before work continues
Additional costs and time extensions may apply.
4. PAYMENT TERMS

A deposit may be required before work begins

Progress payments may be required for larger projects

Final payment is due upon completion unless otherwise agreed
Late payments:

May be subject to interest and recovery costs

May result in suspension of work
We reserve the right to lodge a construction payment claim under the Construction Contracts Act 2002.
5. CLIENT OBLIGATIONS
The client agrees to:

Provide accurate plans, specifications, and information

Ensure site access and readiness

Obtain necessary consents unless agreed otherwise

Make payments on time
Delays caused by the client may result in additional costs.
6. HEALTH AND SAFETY
We comply with the Health and Safety at Work Act 2015.
While on site:

We control site safety during construction

Clients and visitors must follow all safety instructions

No unauthorised access to active work areas
You enter the construction site at your own risk unless supervised.
7. SUBCONTRACTORS AND MATERIALS

We may engage qualified subcontractors

We are responsible for managing subcontractors

Materials used will meet NZ building standards unless specified otherwise
8. WARRANTIES AND DEFECTS
We warrant that:

Work will be carried out with reasonable care and skill

Materials will be suitable for purpose (unless supplied by the client)
Defects Liability

You must notify us of defects within a reasonable time

We will remedy defects in accordance with NZ law
Statutory warranties under the Building Act 2004 apply where relevant.
9. CONSUMER GUARANTEES ACT
If you are a consumer, your rights under the Consumer Guarantees Act 1993 are not limited.
If services are supplied for business purposes, you agree that the Act may not apply, to the extent permitted by law.
10. LIABILITY LIMITATION
To the maximum extent permitted by law:

We are not liable for indirect, consequential, or economic loss

Our liability is limited to the value of the services provided

Weather delays

Supplier shortages

Third-party failures

Inaccurate client information
